Terms of service.
Effective August 4, 2026. The rules of the free-build, flat monthly care arrangement.
These terms govern use of webmaintained.com and the website care services offered by Web Maintained. By submitting the questionnaire, signing an agreement, or paying a subscription, you agree to them. The service
Web Maintained builds small-business websites and keeps them hosted, secured, backed up, and maintained for a flat monthly fee in Canadian dollars. Plans (Care, Care Plus, Care Pro) and inclusions are described on /plans. E-commerce (cart, checkout, payments, inventory) is not included unless quoted separately in writing.
Free build and six-month minimum
We do not charge a separate upfront design or build invoice for sites within the published page limits. In return, plans start with a six-month minimum. After that period, service continues month-to-month until cancelled with 30 days' notice.
Cancelling before the end of the minimum term may make the remaining months of that minimum due, as stated in your signed agreement. We decide case by case whether to enforce unpaid balances for small amounts.
How engagement starts
- You complete the questionnaire or email us.
- If we are a fit, we may provide a free homepage preview before any payment.
- You review and accept a written service agreement and place a payment method on file.
- After the first payment clears, we complete the full build and launch.
We may decline work that is a poor fit (for example certain regulated medical or high-stakes legal sites, or brand requirements we cannot meet well).
Your responsibilities
- Provide accurate business information, logos, photos, and copy in a reasonable time
- Have authority to use any materials you send us
- Keep login credentials you control secure
- Pay the monthly fee when due (typically by autopay)
If client content is not provided within 14 days of request (or another deadline we agree in writing), we may launch with the materials on hand so the project does not stall indefinitely.
What a “page” and “edit” mean
Unless your agreement says otherwise, a page is one URL with roughly up to 500 words of content you supply or approve. Monthly edit hours cover text changes, image swaps, small layout tweaks, contact form updates, and similar work that fits the hour cap. Unused hours do not roll over. Work beyond the cap is quoted first and billed at the overage rate published on the plans page (currently $115 CAD/hour).
Ownership
You own your domain (once transferred or when you brought it), your content, your photos, and copy written for your business. On cancellation we hand over those materials cleanly. The codebase, design system, templates, and hosting configuration stay with Web Maintained — that is what allows the build to stay free. A static export of your pages is available on request for archive purposes.
Domains
If you already have a domain, you keep it where it is and we help point it at the new site. If we buy a standard domain for you as part of the plan, we manage it during the engagement. When you leave after the minimum term (or otherwise as agreed), we transfer that domain to an account you control at no transfer fee from us — typically within 5–7 business days once registrar requirements are met. Premium domains above a normal retail price are quoted before purchase.
Satisfaction guarantee
Within 30 days of your site going live, if you are not satisfied with what we built, tell us in writing. We will refund care fees you have paid for that engagement and end the agreement. The guarantee covers the quality of the build we delivered, not search ranking results (which depend on market competition, reviews, and factors outside our sole control).
SEO and results
Every plan includes technical SEO foundations (speed, structure, titles, schema where appropriate, sitemap). Higher plans add analytics setup and proactive improvements. We do not guarantee specific rankings, traffic, or revenue. Search and AI visibility change over time.
Acceptable use
You may not use the service for illegal content, malware, spam, hate, or anything that would get the hosting account suspended. We may suspend or terminate service for abuse, non-payment, or material breach after notice when practical.
Limitation of liability
To the fullest extent permitted by applicable law, Web Maintained is not liable for indirect, incidental, special, or consequential damages, or lost profits, arising from the service. Our total liability for any claim related to the service is limited to the fees you paid us in the three months before the claim. Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the maximum allowed.
Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules. Courts in Ontario have exclusive jurisdiction, except where consumer protection law requires otherwise.
Changes
We may update these terms for new clients and for renewals. The current version lives at /terms. Material changes for active subscribers will be communicated by email when practical. Continued use after notice may constitute acceptance under your agreement.
